Terms of Use / Service Agreement

Welcome to Indian Matchmaking Service, a website (imms.app) developed by UK based software company called Sujavi Software Solutions Ltd.

If you wish to register as a member and use Imms.app (“site”), you are agreeing to be bound by these terms and conditions. Please refrain from the usage of the website if you disagree with these.

One becomes bound to the agreement on the completion of the registration process through filling out the registration form and checking the box “I have read and agree the Terms and Conditions" on the registration page and using the Service, you agree to be bound by all the terms and conditions of this “Agreement” and sets out the relationship between you (“the Member”) and Indian Matchmaking Service. This Agreement sets out the legally binding terms for your use of the Site and “the Membership” and may be modified by Imms.app from time to time. The membership and rights of admissions are reserved.

Indian Matchmaking Service will endeavour to provide all possible assistance in the case of any other statutory investigation agency to tackle fraudulent users of Imms.app, on being specifically instructed by the said authorities to do so. Please report us any fraud or misuse by giving full details of the issue.



Terms and Conditions:

Eligibility.

  • To register as a member of Indian Matchmaking Service or use this Site, you must be legally competent and of legal marriageable age as per the majority in your jurisdiction of residence and able to form a binding legal agreement.
  •  “the Site” is only to facilitate personal advertisement for lawful marriage alliance between persons who are legally competent to enter into matrimony under the laws to which they are subject.
  • Membership in the Service is void where prohibited. By using this “Site”, you represent and warrant that you have the right, consent, authority, and legal capacity to enter into this “Agreement” and that you are not prohibited or prevented by any applicable law for the time being in force or any order or decree or injunction from any court, tribunal or any such competent authority restraining you from entering into matrimony.
  • You further confirm that you intent to seek a life partner and that you shall not use this site for casual dating. You also agree to abide by all of the terms and conditions of this Agreement.
  •  You confirm that, are not a competitor of Imms.app or are not using the Services for reasons that are in competition with Imms.app.
  • You are agreeing that you will hold only one Imms.app account at any given time and multiple accounts for same person would be disabled if discovered deception.
  • You will not violate any rights of Imms.app other users or of third parties, including intellectual property rights and privacy rights.
  • You agree that Imms.app is not responsible for your necessary infrastructural support to access the website and you agree to provide the cost of all equipment, software, and internet access necessary to use the Services
  • You agree to use your first name and your email address when registering.
  • If at any time Indian Matchmaking Service is of the opinion (in its sole discretion) or has any reason to believe that you are not eligible to become a member or that you have made any misrepresentation, Indian Matchmaking Service reserves the right to forthwith terminate your membership and / or your right to use the Service without any refund to you of any of your un-utilised subscription fee.
  • You will not encourage in your profile or communicate through any conversations any form of harassment, sexual or extra marital affairs. Also no forms of racism, bigotry, violence, invasion of privacy, suggesting, engaging in or enticing other to commit any illegal or immoral acts are also strictly prohibited. Any of these actions from the members can led to termination of the membership without refund and without any liability to Imms.app.
  • The discretion and decisions of Imms.app would be final in these cases.

Password Use and Security

Members are responsible for choosing strong password which should be kept confidential and secure. Imms.app must be notified immediately if you are aware that your account has been compromised. Imms.app is noy liable for any claims or losses related to the use or misuse of your password or account due to the activities of any third party outside of our control or due to your failure to maintain their confidentiality and security.

3. User Account Responsibilities.

To use or access certain services, you must register for and be granted by us an account with Imms.app.

You agree to: a) keep your password secure and confidential; b) not permit others to use your account; c) refrain from using other users’ accounts; d) refrain from selling, trading, or otherwise transferring your Imms.app account to another party; e) refrain from charging anyone for access to the Services; and f) you agree to receive certain specific email from Imms.app.

Further, you are responsible for anything that happens through your account until you close it down or prove that your account security was compromised through no fault of your own. You agree to be responsible for any act or omission of any users that access the Services under your account or using your password that, if undertaken by you, would be a violation of these Terms of Use, and that such act or omission shall be deemed a violation of these Terms of Use.

4. Grant of License

As a registered user of a Service, Imms.app grants to you a non-transferable, non-exclusive and revocable license to use the Service according to the terms and conditions set forth in this Agreement. Except as expressly granted by this Agreement or otherwise by Imms.app or its licensors in writing, you acquire no right, title or license in the Service or any data, content, application, or materials accessed from or incorporated in the Service.

 

5. Services.

The Services provide a platform and mechanism for enabling you to connect and connect with the other Members. Imms.app does not participate in the interaction between you and Members and does not have control over the quality, reliability, timing, legality, integrity, authenticity, accuracy, appropriateness, provision, or failure to provide, or responsiveness of the information provided by or to the other Members, and does not monitor or control whether any participant, including registered users and/or visitors to the Site, are who they claim to be. Imms.app makes no representations about any of these and assumes no responsibility for any of them as more fully set forth below. Imms.app does not recommend or endorse any specific bride or bridegroom listed on the website or any other information regarding them that may be mentioned through Services.

 

6. Term.

This Agreement will remain in full force and effect while you use the Site and/or are a Member of Imms.app. You may terminate your membership at any time, for any reason by informing Imms.app in writing to terminate your Membership. In the event you terminate your membership, you will not be entitled to a refund of any unutilised subscription fees. Imms.app may terminate your access to the site and/or your membership for any reason which shall be effective upon sending notice of termination to you at the email address you provide in your application for membership or such other email address as you may later provide to Imms.app. If Imms.app terminates your membership because of a breach of the agreement by you, you will not be entitled to any refund of any unused Subscription fees.

 

7. Non-Commercial Use by Members.

The Imms.app Site is for the personal use of individual members only and may not be used in connection with any commercial endeavours. This includes providing links to other websites, whether deemed competitive to Imms.app or otherwise. Organisations, companies, and/or businesses may not become Members of Imms.app and should not use the Imms.app Service or Site for any purpose. Illegal and/or unauthorised uses of the Site, including unauthorised framing of or linking to the Site will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.

8. Other Terms of Use by Members.

Indian Matchmaking Service reserves the right in its sole discretion to review the activities and status of each account and block the account of a member based on such review.

 You hereby confirm that, you are not engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service. As on date of this registration, you do not have any objection to receive emails, messages and calls from Imms.app and members of Imms.app as long as you are a registered member of Imms.app. You will not transmit any chain letters or junk email to other Imms.app Members. Although Imms.app cannot monitor the conduct of its Members on the Imms.app Site, it is also a violation of this Agreement to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect Imms.app and/or our members from any abuse/misuse, Imms.app reserves the right to restrict the number of communications/profile contacts & responses/emails which a Member may send to other Member(s) in any 24-hour period to a number which Imms.app deems appropriate in its sole discretion. You will not send any messages to other Members that are obscene, lewd, licentious, and defamatory, promote hatred and/or are racial or abusive in any manner. Transmission of any such messages shall constitute a breach of this Agreement and Imms.app shall be entitled to terminate your membership forthwith. Imms.app reserves the right to screen messages that you may send to other Member(s) and also regulate the number of your chat sessions in its sole discretion.

You may not use any automated processes, including IRC Bots, EXE's, CGI or any other programs/scripts to view content on or communicate/contact/respond/interact with Imms.app and/or its members.

You confirm that the Content, information including the personal information provided by you is correct and accurate.

9. Content Posted on the Site.

Indian Matchmaking Service owns and retains all proprietary rights in the Imms.app and the Services. These rights include without limitation to all intellectual property rights in the Imms.app. The Site contains the copyrighted material, trademarks, and other proprietary information of Imms.app, and its licensors. Except for that information which is in the public domain or for which you have been given express permission by Imms.app, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. All lawful, legal and non-objectionable messages (in the sole discretion of Imms.app), content and/or other information, content or material that you post on the forum boards shall become the property of Imms.app. Any such act or an attempted act on your part shall constitute a violation of this Agreement and your membership is liable to be terminated forthwith by Imms.app without refund of any of your unused Subscription fees. Indian Matchmaking Service reserves right to take legal action (civil and/or criminal) wherever applicable for any violations.

 

Content Posted on the Site:

Imms.app reserves the right to scrutinise all such information, content and/or material posted on the forum boards and shall have the exclusive right to either remove, edit and/or display such information, material and/or content. You understand and agree that Imms.app may delete any content, messages, photos or profiles (collectively, "Content") that in the sole judgment of Imms.app violates this Agreement or which might be offensive, illegal, defamatory, obscene, libellous, or that might violate the rights, harm, or threaten the safety of other Imms.app Members.

You are solely responsible for the content that you publish or display (hereinafter, "post") on the Site through the Imms.app, or transmit to other Imms.app Members. Imms.app reserves the right to verify the authenticity of Content posted on the Site. In exercising this right, Imms.app may ask you to provide any documentary or other form of evidence supporting the Content you post on the Site. If you fail to produce such evidence, or if such evidence does not in the reasonable opinion of Imms.app establish or justify the claim, Imms.app may, in its sole discretion, terminate your membership without a refund of your subscription fees

By posting content to any public area of Imms.app, you automatically grant, and you represent and warrant that you have the right to grant, to Imms.app, and other Imms.app Members, an irrevocable, perpetual, non-exclusive, fully-paid, worldwide unlimited, assignable, sub-licensable, fully paid-up and royalty-free right  to use, copy, perform, publish, display, and distribute such information and content and to prepare derivative works of, improve, remove, retain, add, process, analyse, use and commercialise, in any way now known or in the future discovered, the information you provide, directly or indirectly to Imms.app , including, without limitation, user-generated content, ideas, concepts, techniques and/or data, or incorporate into other works, such information and content, and to grant and authorise sublicenses of the foregoing. Any information you submit to us is at your own risk of loss.

The following is a partial list of the kind of Content that is illegal or prohibited on the Site. Imms.app will investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and the Site and terminating the Membership of such violators without a refund. It includes (but is not limited to) Content that:

Newly created profile will be checked for correctness and will be immediately activated after quality declaration is verified by Imms.app.

Imms.app reserves the rights to discontinue, deactivate, or terminate profile if the profile is in terms of bad manners and the profile contents are not acceptable if it contains violent language or wrong material.

You are only liable for your connections with other members through Imms.app

Members agree that they are legally eligible to get married as far as the age is concerned. Imms.app will not be responsible for misuse of any facility/service it provides, which is in violation of your Country’s laws.

Every member submitting his/her matrimonial profile is required to give all the honest facts is essential for establish a right/suitable match. Concealing facts relevant to marriage could result in loss or damage to any individual and Imms.app shall not be held responsible in any manner for such concealment.

Imms.app cannot guarantee the genuineness of the information provided by its user members.

Members will not have any claim against Imms.app for any time delay in posting their information into Imms.app website due to any technical reasons.

Imms.app is not liable for damages caused due to incorrectness of the information provided by its members regarding the religion, caste or creed, financial or any other personal information. If the members’ profile is deemed to be unfit, Imms.app has the right to delete, alter or refuse the same at any point of time without any notice.

Imms.app cannot be held responsible for any loss or damage resulting from discontinuation of the service. Imms.app will also not be responsible for any damage caused due to others accessing members’ profile.

Imms.app cannot guarantee that you as an applicant will receive responses and hence Imms.app shall not be held responsible for no replies. In this case where the member fails to get any response from other members, Imms.app shall not give any refunds or credits.

Imms.app is not legally responsible for any delay in operation due to technical or other reasons.

 

Harasses or advocates harassment of another person;

Involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";

Promotes information that the person posting it is aware that it is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;

Promotes an illegal or unauthorised copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

Contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
